If you are involved in any type of child custody battle it is crucial that you understand the different variations and consequences of Custody.

Here are some of the terms that are commonly used in Child Custody battles:

Joint custody
Joint custody is a system in which the court awards custody, or care of the child to both parents equally. Both parents become custodial parents and jointly share responsibility for the child.
This can then be further broken down into two separate methods Joint Legal custody and joint physical custody.

Joint Legal custody
In joint legal custody both parents have full access to any records that pertain to the child’s health, education or related necessary needs. Both parents also have equal decision making ability regarding the child’s future, school, health and any important decisions.

Joint Physical custody
Joint physical custody, also known as joint physical care makes allowances for equal and planned parental physical care. Each parent has the right to physically have the child stay by them for a set amount of time each week/month/year.  This is dependent on individual circumstances and is often a point of contention that needs to be worked out with a experienced family lawyer.

Sole custody
Sole custody provides a single parent with all the power and responsibility involved in raising a child (or children). The parent who has sole custody makes all decisions regarding the child’s future i.e.his education, lifestyle and more. The other parent is said to be the non-custodial parent, and may or may not have visitation rights. This is dependent on a host of factors, primarily “what is in the child’s best interest”..
