Assaults can happen anywhere and any time. This can include any aggressive or intimidating actions that occur between spouses, girlfriends/boyfriends, children, parents, grandparents or any individuals that are related to one another. Domestic violence is a serious offence that is fiercely prosecuted by the Crown.
Assault is often broken down into two separate categories. Regular assault and Aggravated assault.
An individual can be arrested for assault even though even though he doesn’t actually harm anybody. Rather, assault implies the intention to commit bodily harm along with an ability to actually carry out the threat.
For example if you raise your fist and threaten to hit an individual with it, that is considered assault whether or not you actually carry out the threat. However the victim must also have a genuine fear that such an action can occur.
Simply touching someone against their will, can result in an assault charge
AGGRAVATED ASSAULT
Aggravated Assault is generally a term associated with a threat accompanied by a physical force great enough to seriously harm the victim. Any show of deadly force (i.e a knife or gun) or attempt at kidnapping is usually prosecuted under the more serious charge of aggravated assault.
